DEFINITIONS
1.1 “KBS” refers to KBS Electrical Contractors (Pty) Ltd, including its directors, employees, and authorised representatives.
1.2 “Subcontractor” refers to any independent third-party contractor engaged or coordinated by KBS to provide specialised services, including but not limited to plumbing, gas, or beetle inspections and certifications.
1.3 “Services” refers to all inspection, testing, certification, fault finding, and repair work arranged by KBS, whether performed by KBS directly or by a Subcontractor.
1.4 “Client” refers to the person, entity, seller, purchaser, agent, or representative requesting services.
1.5 “COC” refers to a Certificate of Compliance issued in accordance with applicable legislation.
2. APPLICATION OF TERMS
2.1 These Terms and Conditions apply to all Services arranged by KBS, including Services performed by Subcontractors.
2.2 The Client acknowledges that:
- KBS coordinates and administers Services as a single process for the Client’s convenience; and
- Operational terms including inspection fees, access requirements, scheduling, delays, and payment terms apply equally to Services performed by Subcontractors.
2.3 Where Services are performed by a Subcontractor:
- The Subcontractor remains responsible for their own workmanship, compliance, and certification;
- All administrative and commercial terms contained herein remain applicable.
3. APPLICABLE LAW AND COMPLIANCE
3.1 All inspections and certifications are conducted in accordance with applicable legislation, including:
- SANS 10142-1 (Wiring Code)
- Occupational Health and Safety Act, 85 of 1993
- Electrical Installation Regulations
3.2 The scope of inspection is limited strictly to legal compliance requirements necessary for issuing a COC.
3.3 Cosmetic, aesthetic, or non-safety-related defects are excluded unless, in KBS’s sole discretion, such defects may give rise to a material dispute.
4. QUOTATIONS
4.1 All quotations are valid for thirty (30) days unless otherwise stated.
4.2 Quotations are based on conditions visible and testable at the time of inspection.
4.3 KBS reserves the right to amend quotations should additional defects or conditions be identified.
5. INSPECTION FEES
5.1 An inspection fee is charged for all compliance inspections conducted by KBS or arranged through Subcontractors.
5.2 The inspection fee constitutes a standalone professional service, including testing, assessment, and reporting.
5.3 The inspection fee is payable in full irrespective of whether:
- The quotation is accepted; or
- The Client elects to proceed with repairs.
6. DISTRIBUTION BOARDS (DB BOARDS)
6.1 The standard inspection fee includes assessment of one (1) main distribution board.
6.2 Each additional distribution board shall be charged at:
R172.50 (One Hundred and Seventy Two Rand and Fifty Cents) incl. VAT per additional DB board.
6.3 Where the number of DB boards is not disclosed prior to inspection, KBS shall determine such number on site and invoice accordingly.
7. LATENT AND ADDITIONAL DEFECTS
7.1 Quotations are based on defects visible and identifiable during inspection.
7.2 Additional defects may become apparent during repair work, including latent or concealed defects.
7.3 Any such additional work:
- Shall be communicated to the Client;
- Shall be subject to a revised quotation; and
- Shall not proceed without Client approval.
8. ADDITIONAL WORK AND SCOPE
8.1 Any work requested outside the scope of the original quotation shall be:
- Quoted separately; or
- Charged at KBS’s applicable labour rates.
8.2 No additional work shall be undertaken without prior approval from the Client.
9. WORKMANSHIP AND MAINTENANCE
9.1 KBS provides a workmanship guarantee limited to work performed by KBS.
9.2 KBS shall not be liable for defects arising from:
- Normal wear and tear;
- Ageing infrastructure;
- Environmental or external factors;
- Loadshedding or power surges;
- Pre-existing conditions not directly related to KBS’s work.
9.3 Any new faults arising after completion shall be treated as new work unless directly attributable to KBS workmanship.
10. CLIENT-SUPPLIED MATERIALS
10.1 KBS does not warrant or guarantee any materials supplied by the Client.
10.2 KBS shall not be liable for failure, incompatibility, or defects arising from such materials.
11. APPLIANCES AND EARTH LEAKAGE
11.1 Appliances do not form part of the electrical installation covered by a COC.
11.2 Where compliance requires connection of appliances to earth leakage protection, any resulting tripping shall indicate an internal appliance fault.
11.3 KBS accepts no liability for appliance defects identified during compliance.
12. CERTIFICATE OF COMPLIANCE (COC)
12.1 A COC is valid for two (2) years, provided no alterations are made to the installation.
12.2 Any modification or work carried out by a third party shall render the COC invalid.
12.3 The COC covers the electrical installation up to the point of consumption and excludes appliances.
12.4 KBS reserves the right to refuse issuance of a COC where the installation does not comply with applicable regulations.
13. THIRD-PARTY WORK
13.1 KBS accepts no responsibility for work carried out by third parties not arranged by KBS.
13.2 Any contractor performing independent work must issue their own certification.
14. ACCESS AND APPOINTMENTS
14.1 The Client shall ensure full access to the property at the scheduled time.
14.2 Where access is not provided:
- A call-out fee may be charged; and
- A new appointment shall be required.
14.3 These access requirements apply to all Services, including those performed by Subcontractors.
15. PAYMENT TERMS
15.1 Unless otherwise agreed in writing, payment is due upon completion of work.
15.2 Where payment is to be made via transferring attorneys:
- The Client remains ultimately liable for payment;
- Delays in transfer shall not affect the Client’s obligation to pay.
15.3 KBS reserves the right to withhold any certification until full payment is received.
15.4 These payment terms apply to all Services arranged by KBS, including those performed by Subcontractors.
16. WORKING HOURS AND AFTER-HOURS WORK
16.1 Standard working hours are Monday to Friday, 08:00 to 17:00.
16.2 Work outside these hours may be subject to adjusted labour rates.
17. DELAYS
17.1 Any timeframes provided are estimates only.
17.2 KBS shall not be liable for delays caused by:
Subcontractor availability;
Complex fault finding;
Material availability;
Access restrictions;
External factors beyond its control.
18. REMOVAL OF MATERIALS
18.1 Removed or replaced components shall be left on site by default.
18.2 Removal may be arranged upon prior written request from the Client.
19. COMMUNICATION
19.1 All official communication and approvals must be directed through KBS’s designated office channels.
19.2 KBS shall not be bound by instructions or approvals provided through informal or unauthorised communication channels.
20. LIMITATION OF LIABILITY
20.1 KBS shall not be liable for:
Damage caused by load shedding or power surges;
Indirect, consequential, or incidental losses;
Losses arising from factors beyond its control.
20.2 KBS’s liability is limited to the value of the services rendered by KBS.
21. SUBCONTRACTED SERVICES
21.1 KBS may coordinate specialised services through Subcontractors as part of a broader compliance process.
21.2 KBS facilitates booking, communication, and administration of such Services for the Client’s convenience.
21.3 While KBS applies consistent operational standards across all Services:
Each Subcontractor remains responsible for their own workmanship, compliance, and certification.
21.4 Any technical defects or claims relating to Subcontractor work must be addressed with the relevant Subcontractor.
22. GENERAL
22.1 These Terms and Conditions apply to all Services rendered or arranged by KBS.
22.2 Booking of Services or acceptance of a quotation constitutes acceptance of these Terms and Conditions.
22.3 No variation of these Terms shall be binding unless agreed in writing by KBS.
